Abstract

Agriculture role which very strategic in national economy matters hasn’t balanced with adequate funding support. Credit proportion distribution from national bank institution quite low accepted by agriculture sector, the this situation happened because farmers doesn’t have any collateral which difficult bank to give credit. On the other hand, bank has to watch the principle of prudence in order to give credit. Notice such a phenomenon, the need for efforts to establish a bank for farmers. Establishment a bank for farmers also mandated by Article 63 Letter e Constitutional Law Number 41 of 2009 about Protection of Agricultural Land for Sustainable Food. Purpose of the establishment of agricultural bank is to funding agricultural sector in credit form. Fact, until now the government hasn’t issue any implementing regulations, even though the establishment of agricultural bank is very needed towards consummate farmer’s welfare. This research using normative legal research method in order to acknowledge and analyze legal factor which support and obstruct the establishment of agricultural bank. The results show that conceptual, agricultural bank very prospected to establish in Indonesia, however legally establishment of agricultural bank obstruct by bank establishment regulations which unfit for agricultural sector.
