Abstract

Life insurance claim denials by the insured to the insurer resulted in the legal disput0oot"veen the insured to the insurer. In connection with this, the research focus is on Liability Insurer on Life Insurance Claim Denial Insured. The problem faced is how the legal responsibility of the insurer on the insured life insurance claim denial and how fonns of barriers that cause the insurer refused to withdraw a claim to the insured and solutions used or offered. The research rnethod using a type of research that focuses on the nornlative assessnlent of legislation related to the Insurance. The, results of the research conducted, that the liability insurer for denial of insurance claims life in_sured if caused by the fault of the insured, the insurer returns the premiums of the value of an existing account on the policy insured, othenvise if errors resulting from insurance agent as a representative of the insurer, then the top the act of applying criminal sanctions lU1der Article 75 or Article 71 Constitution Number 40 in 2014 on insurance and the insurer shall be liable for the payment of claims which arise when the insurance agent has received a premiun1 but not yet handed to the insurer. Barriers that cause the insurer refuses to withdraw the claim is an insurance agent fraudulently convey inforn1ation to the insured in the insurance product and failure to apply the principle of interest (insurable interest) and the principle of good faith perfect (utmost good faith).
