Abstract

Cybercrime is happening nowadays in Indonesia. This happens because Indonesia is geographically located between Asia and Australia and between Pacific and Indian Ocean. This geographic location also makes the trade of goods in Indonesia more complex and various. People tend to obtain their needs instantly in order to make everything in their life easier and faster. Indonesian government through Bank Indonesia has released credit card. Credit card makes people easy to do transaction. Crime in credit card which has occurred recently is credit card fraud. There were 2 problems formulated in this study; 1) what kind of legalprotection that police gives to the victims of credit card fraud, and 2) what obstacles that police encounter in giving legal protection to the victims of credit card fraud. The method applied in this study was normative legal research which focused on the existing legislation. There were three sources of data applied in this study; 1) primary legal, 2) secondary legal, and 3) tertiary legal source. To deal with credit card fraud, police has taken the preventive and repressive actions to reduce this kind of crime. Besides, police by other parties’ help also provides the socialization of credit card use and its risk that might happen. It is expected that credit card fraud can be reduced and repressed. The obstacles that police encountered in investigation were the difficulty to arrest the criminal, the difficulty to obtain the confidential data from bank, inadequate equipment and facilities, and lack of knowledge about information technology.
