Abstract

The title of this research was “THE TRANSITION OF OWNERSHIP RIGHTS ABSENTEE LAND (SELL BUY TRANSACTION) IN MAKING CERTAINTY OF LAW IN GAMBUT SUBDISTRICT OF BANJAR DISTRICT SOUTH KALIMANTAN PROVINCE”, with the formulation of the problem is how the transition of ownership rights of absentee land (sell buy transaction) in Gambut Subdistrict of Banjar District and whether the transition of ownership rights of absentee land (sell buy transaction) in Gambut Subdistrict of Banjar District has been providing legal certainty. The Objective of this research is to know, how the transition absentee ownership rights over land (sell buy transaction) in Gambut Subdistrict of Banjar District and to determine whether the transition of ownership rights of absentee land (sell buy transaction) in Gambut Subdistrict of Banjar District has been providing legal certainty. Results of this research is that the transition of ownership of absentee land (for selling) in Gambut Subdistrict of Banjar District the majority of respondents (75%) had done before PPAT. The deed of sale is conducted in the presence of PPAT, it has a function as evidence of a legal act and as one of the requirements for the registration process rights transferring it to the local Land Office while (25%) of respondents transition of ownership of absentee land has been made before a Notary and are already realizing the legal certainty because most have to register transfer of rights to land at the local Land Office that obtained the certificate of land rights.
