Abstract

Practice in political parties’ coalition done in the government which is held by President SBY has created many state affairs problems and it is not effective to run the presidential government system and to maintain the government stability. Besides, the big power from the representatives makes presidents powerful and president can influence voting in that institution. Based on that background above, I state problem as the following: 1. How is the implication of political parties in the government towards the effectiveness of governmental administration? 2. How is the implication of political parties’ coalition in the government towards check and balance mechanism between legislatives (Indonesian Legislative Assembly) and executives? This research is aimed to collect data which consequently be analyzed to know how the implication of political parties coalition in the government towards the effectiveness of governmental administration is and to know how the implication of implication of political parties coalition in the government towards check and balance mechanism between legislatives (Indonesian Legislative Assembly) and executives is. The type of research in law writing / thesis is normative law research, that is a research focusing on norm (law in book) in form of constitutions. This research needs secondary data as the main data. The method of collecting data in the thesis is a library research. Normative law research uses qualitative analysis which involves qualitative measure. Deductive thinking is used in thinking process to draw a conclusion. By maintaining political parties coalition in President SBY’s governmental system, it brings effect on the ineffectiveness towards governmental administration which is labeled by the ‘loss’ of president’s constitutional rights to determine the cabinet in his hand. Besides, the coalition also impacts on the absence of check and balance mechanism between legislatives (Indonesian Legislative Assembly) and government (executives), which can be identified in the ‘loss’ of representatives’ constitutional rights. Government can effectively execute the governmental administration when president as the head of the government is consistent to carry out the governmental affairs fitting with the characteristic of presidential system. The Indonesian Legislative Assembly (legislatives) and government (executives) constantly do their constitutional functions as mandated by constitution and they keep their independency to facilitate check and balance mechanism of both institutions, particularly the controlling function of legislatives (Indonesian Legislative Assembly) towards governmental administration done by executives.
