Abstract

Gold mining activities in the Landak are not only legally managed by companies but there are also traditional sans legal mining activities managed by the locals. Mining activities, whether legal or not legal, tend to cause degradation or damage to the environment. Legal issues are examined first, how is the control of environmental degradation as a result of legal gold mining in Menyuke River, Landak Regency and secondly, whether there are any obstacles faced in carrying out control of environmental damage as a result of legal gold mining in the Menyuke River, Landak Regency. This research is an empirical legal research with the data collected through interviews with respondents and interviewees as well as the study of library. The results showed that the Department of Mining and Energy has conducted dissemination in Landak regency about the impact of illegal gold mining, detaining of the perpetrators, and curbing the perpetrators of illegal gold mining. In addition, supervision and coordination by Environmental Agencies in conducting the Menyuke River, Landak Regency recovery with reforestation of land against a former illegal gold mining and Agriculture and seeds provide help plantation to the perpetrators of the illegal gold mining. However, in practice, the control of environmental damage is not running optimally, due to a lack of constraints on the amount of human resources owned by the Environmental Agency of the Menyuke River, Landak Regency, as well as the absence of a criminal law process conducted by units of the Police Districts and the Civil Service Police division of, Landak Regency against the perpetrators of the illegal gold mining. As for the author's advice is: the perpetrators of the illegal gold mining are encouraged to have permissions or switch professions, and reform need to be made more consistent.
