Abstract

Since publised “Undang-Undang Nomor 44 Tahun 2008 tentang Pornografi” is the realiztion of the Goverment in order to evercome pornography in public life, which is a problem often encountered in development of information technology. The purpose of this study was to obtain an explaination of the existence of the provision of criminals sanctions against perpetrators download pornographic content. The menthods used in this study are normative legal menthod. The results of the results of the research the author did was “Pasal 5 Undang-Undang Nomor 44 Tahun 2008 tentang Pornografi” needs to be updated, since in the article did not mention specifcs about the abuser download pornographic content. The need to see good faith from someone who download pornographic content, is one of determining whether someone download pornographic conten worthy of ciminalization to be done or not. Based on the results of the analysis of the data obtained by the author, then it can ve concluded that the aplication of criminal sanctions in “Pasal 5 Undang-Undang Nomor 44 Tahun 2008 tentang Pornografi” should be updated and accordance with the effors that have to be rational to tackle crime, then it shouldlook at the element of intentionally or unintentionally someone when accessing pornographic content which give to rise to legas consequences.
