Abstract

The partnership agreement between investor and cooperative on the rights and obligations of the problems sometimes occur where an obligation is violated only because it wants its rights to be fulfilled without considering whether the obligation itself has been executed. Problems also can occur when the contents of a partnership agreement concerning the rights and obligations are unclear, and this raises the question of what the rights and obligations of the parties.By using normative research approach which uses law (Statute Approach) that approach by using legislation and regulations. Found results that;Agreement between cooperative and investor in the PIR (plantation core people) initially involving TKP3K but, in the end the problem resolved only between cooperative and investor alone. The problem of FFB (fresh fruit bunches) problem can be resolved directly between the parties without involving TKP3K with the parties back a new loan agreement/additional. thus it can be concluded that the completion of the implementation of the fulfillment of the rights and obligations of investors related to the PIR (plantation core people) completed with the investors immediately split nucleus that belong to the cooperative without involving TKP3K or involving TKP3K and patterns of TBS (FFB) resolved with the parties to re-create a new treaty involving issues TKP3K in terms idenfying up, reaching an agreement between the parties contained in an agreement that includes the fulfillment of the rights and obligations of the parties previously been a problem.
