Abstract

Towards a marriage, there is the principle of monogamy inside, no matter for marriage Islamic religious communities and marriage Catholic religious communities. Surely, to find out the similarities and the differences among them can be using a comparison of law. The purposes of this research are to examine what is the notion of the principle of monogamy on marriage based on Islamic law matrimonial and Canonical law matrimonial. The research model for this study is normative law, means that it is focusing on law positive norm, such as rules legislation and rules of law religion with action, description, systematic, analysis, interpretation, and positive law judge, vertically and horizontally to know the notion of the principle of monogamy in law of Islamic matrimonial and law of Canonical matrimonial. The result of this study is both of them whether it is Islam religion and Catholic religion basically having the high expectation that the marriage should be in monogamy style although there are differences between both of those religions, since the monogamy principle of Catholic is absolute and the monogamy principle of Islam religion is not absolute.
