Abstract

The title of this thesis is Juridicial Review Inclusion The Name Of Parents On Birth Certificate’s Waif In Orphanage. Birth certificate is really important, no exception for waif who not known about their parents. Then, is there any rules about inclusion the name of parents in birth certificate’s waif and how about juridicial consequences of inclusion the name of parents in birth certificate’s waif ? This thesis aim to know in a juridicial manner the rule about inclusion the name of parents in birth certificate of waif and juridicial consequences of inclusion the name of parents in birth certificate’s waif. Research methods in this thesis is normative legal research which focused on norm positive law in the form of regulation. The results of data analysis are birth certificate of waif has arranged in Ministerial Regulation number 9 of 2016 about The Acceleration Of An Increase In The Scope Of Ownership Of Birth Certificates but in that rule not mention about inclusion the name of parents. Consequences from inclusion the name of parents in birth certificate’s waif is emergence the right and obligation between parents and child whose names were attached in birth certificate moreover there were also criminal sanctions about embezzement of the origin which is regulated and threatened with Clause 277 subsection (1) The Code of Criminal Law.
