Abstract

The legal writing of this essay law contains about the “antinomy" of one law with another law, especially the regulation that regulates the eradication of corruption. Corruption is including the criminal act that refers to an extraordinary crime. Because of the continuous act of corruption in Indonesia up to now; the infrastructure development is impeded, public services are not well organized, the quality of human resources decreases and the act of practical politics improves. The Article 4 of Law Number 31 Year 1999 about the eradication of corruption confirms that the return of state financial loss does not abolish the criminal responsibility. On the other hand, in anotherregulation, the law of Audit Board of the Republic of Indonesiaaccepts the return of state financial loss by giving grace period for sixty days since the announcement of the state financial loss. This situation gives impact on the process of investigation. More over, the return of the state financial loss will abolish the criminal element that is the loss of state financial.
