Abstract

The title of this research is “Juridical Analysis of Act No. 20/2008 about Micro, Small and Medium Company (UMKM) In Relation With Business Competition Of Social Equity Among Businessmen”. This research is aimed to obtain information regarding the application of social equity (distributive equality) within Act No. 20/2008 which specify businessmen as the subject. The term of businessmen is referred to Micro, Small and Medium Company. Under the Act a quo, Micro and Small Company inherit privilleges in various term. Under the Act a quo, distributive justice (social equity) is underlining the privilleges which received by Micro and Small Company. Those privilleges are projected to gain issues and brought to the defenition of justice. Depends on the context, term of justice has various defenitions. The defenition of justice might be vary, but the aim is supposively remain the same. Same in this context is referred to the application of the law for every law subject. The type of this research is qualitative normative by means of deductive method. The results from the analysis shows the injustice material of Act No. 20/2008 among businessmen. The lack of consideration of designing law as a preventive measure is one of the reasoning found within Act a quo.
