Abstract
This research discusses about the fulfillment of labor rights in the bankrupt company. In this case, there are some companies which are bankrupt and the labor rights either the wage or the separation pay cannot be fulfilled. This research focuses on one problem that how to fulfill the labor rights in the bankrupt company. This research aims to know about the fulfillment of labor rights in the bankrupt company. The research uses the normative legal research methods which focus on the positive law norm in the form of the rules about the fulfillment of labor rights in the bankrupt company. This research conducted by literature study which is to collect data by studying related regulations using deductive methodology. The result of this research is companies that have received a bankruptcy decision by the court shall not at all reduce or eliminate the rights of workers, this is based on the verdict of Constitutional Court cases No.67/PUUXI/ 2013 in accordance with the constitution of the Republic of Indonesia in 1945 which protect the rights of workers and the welfare of mankind. The verdict changed the practice that has put the right of workers in the last order when the company declared bankrupt.
