Abstract

Corruption is a criminal act that inflict the financial loss and economy of the country. Corruption also obstruct national development so it has to eradicated in order to create and a just and prosperous society based on Pancasila, Undang-Udang Dasar 1945, TAP MPR. As much as is proper, a right and clean goverment system must be formed. This Legal essay is made by the author using a deductive metode that the process of reasoning from one or more statements (premises) to reach a logically certain conclusion. In this matter, the conclusion is related to the legislation of the restoration of state money that assumpted has been corrupted by the accused who has died. Therefore the data source that used in this normative research is secondary data that taken from literature studies. The secondary data is the main of legal opinion that taken from books, journals, research result, newspaper, internet, legal facts, and legal institute's statistic.The restoration of state money that has been corrupted by the accused who has died must be vendicted to the accused. The accused is sued for seize state money that has been corrupted. So the money will come back into state finance.
