Abstract

Problems related to the existence of communal land of indigenous peoples of Karo in Karo district in North Sumatera province about land belongs to communal (communal land) so that if there are outside parties who want to own communal land are not allowed unless the indigenous people who have the same offspring genealogically. However, if there are any outsiders wishing to own customary land they must go through the procedures prescribed by local customary law. If they are allowed to stay, they will not be given a common property right but they will only obtain the right to use. How is the existence of communal land of indigenous people of Karo in Karo regency of North Sumatera province The result of the research shows that in Karo district there is communal land of customary law community which is eligible to be established as communal land and only indigenous law community can own the communal land.
