Abstract

This writing law entitled is effectiveness of law policy exactly on the criminal selling and buying of organs and or tissue of the human body. The purpose of this writing law is to determine effectiveness of law policy exactly on the criminal selling and buying of organs and or tissue of the human body.The research method used in this writing law is a normative legal writing, focuses on the statutory provisions. However, in order to obtain a comprehensive discussion, the legal writing is combined with empirical data obtained through interviews with relevant resource persons, as well as the study of literature. All data were obtained from provisions of law and the empirical data then analyzed qualitatively and presented descriptively.From the results of research conducted by the authors, the practice of selling and buying organs and tissues of the human body or a prohibited act, affirmed in Article 64 paragraph (3) of Law No. 36 of 2009 on Health and described further in the presence of criminal sanctions in Article (192) Law No. 39 of 2009 on Health. Thus, the juridical practice of selling and buying organs and or tissues of the body is a prohibited act by the principle of legality.Seeing these conditions, the law enforcement officers in this case police should be more proactive to take actions on the practice of selling and buying of organs and or tissues of the body in the community, government regulations that further regulate the practice of selling and buying of organs and or tissues of the human body. To reinforce the provisions of law No. 39 of 2009 on health, the agency or institution specifically designated to oversee the regulation for more leverage.
