Abstract

National development was aimed to materialize a lawful and prosperous society both materially and spiritually based on Pancasila (Five Pillars of Indonesia) and 1945 Constitution’s free, sovereign and united in Indonesian state. Psychotropic abuse more happened in the society and various kinds of psychotropic more spread. Psychotropic abuse criminal has penetrated Indonesian Armed Forces (TNI). Whereas, there were main components in state defense system and as state apparatus that was assigned to maintain, protect, and keep state wholeness and unity. One of most role law enforcer apparatus was a judge. Based on the above explanation that was discussed could be taken its case whether psychotropic abuse forms that much occur in military group so that it could be concluded from the case. A psychotropic abuse form that much happened in military environment that was assembled in Military Court of Yogyakarta was a military member as a psychotropic user instead of victim or dealer. Most of psychotropic abuse was methamphetamine and criminal charged to the military member who was proven to abuse group II psychotropic or group I narcotics was maximum criminal imprison of 4 year maximum. Judge’s consideration base in giving verdict towards psychotropic abuse was methamphetamine that based on weighting on and relieving circumstances.
