Abstract

Implementation of Article 64 Paragraph (2) from Legislation on 23 in 2002 about special protection for children who face with law from Setianing Dyah Kusumawati. Legal issues that exist are special protection for childen who face with law not given by children rights based on Minimum Standart of United Nations. The purpose of this research is the application of Article 64 Paragraph (2) from Legislation on 23 in 2002 can applied optimally also with due regard the Minimum Standart of United Nations especially for the children who face with law who get punishment in Penitentiary for Children in kutoarjo, so guaranteed their rights. The research that used is empirical law research. Primary of data sources are obtained from interview the sources. Secondaryof data are primary legal materials. The result of research in Panitentiary for Children in Kutoarjo is application of Article 64 Paragraph (2) from Legislation on 23 in 2002 not applied optimally and activities for convicts are limited by reason of operations costs. The effort for maintaining relationships with their parents has attempted optimally by employee of penitentiary, but their parents are difficult to contact.
