Abstract

The pure military crime is a criminal action of conducted by a military, by reason of the particular traits of military. One of the pure military crime of which often conducted in the environment of Indonesian Military Army is the crime which is a way for a military to draw himself from the implementation of formal duties is the desertion crimes. Meanwhile the desertion crime is regulated in the Article 87 of the Law Number 39 of 1947 (KUHPM). The purpose this legal research was 1)To find out what are the factors which cause members of the Indonesian National Army committing a crime of desertion, and 2) to find out how efforts to control the crime of desertion committed by members of the Indonesian National Army. The type of research conducted in the compilation of this thesis was normative, i.e. a research focused on the norms and this research needed secondary data (legal source) as main data and collected any data from the parties who comprehend about the studied case by conducting interview with the source persons. The conclusion of this legal writing/thesis is: Firstly, there are two factors causing the members of Indonesian Military Army to conduct desertion crime, i.e. internal and external factors; Second conclusion of this legal writing/thesis is the crime prevention efforts desertion committed by military members are divided into two ways; first is preventively and second is repressively.
