Abstract

The Title of this research is Solving Financial Loss of the State caused by Administratif Error of Goverment Officer. This research aimed to find out and analyze that administrative error which causing financial loss can make the government officer free from criminal charges of corruption, to find out and analyze how to solve financial problem of the state caused by administrative error of goverment officer and to find out and analyze the accountability forms of those officer toward financial loss of the state caused by administrative error. This research uses Normative Method which is focused on norms of positive law. The result of the research shows that administrative error which is done by government officer is not merely categorized as criminal act of corruption as long as it done in the line of duty as government officer and there as no such abuse of power. The financial loss of the state caused by administrative error of goverment officer can be solved by an administrative law procedure which constrains the goverment officer to restore all the number of state’s financial lose into state’s case. The goverment officer can be charged which criminal act of corruption in the terms of power abuse that leads into financial loss. The financial loss of state caused by administrative error of goverment officer will be considered as the position responsibility in the line of government abuse in the line of govermental duty according to the law, and it will be considered as private responsibility if there is a power abuse in the line of governmental duty.
