Abstract

This research aims to find out whether the persecution committed by teachers against pupils can apply to mediation and did great things against can be applied to mediation. The type of research used is normative research. Normative research is research that is focused on the positive legal norms. The data used in the writing of these are primary data and secondary data. Contains the primary data about the Legislation while the secondary data contains in the form of legal opinions and non-legal opinions derived from literature, journals and internet. Legal opinions are also obtained from experts. The police have an important role in conducting mediation, because there have been many cases that occurred between teacher and student. Such cases immediately brought to justice and it's not entirely fair because less persecution committed by teachers against pupils carried over the teacher's will of itself, then the penal mediation is required to complete the the problems with the aim of finding a better solution and benefit both parties reason together. Penal mediation setting police already are supposed to be regulated in detail.
