Abstract

Education is a part of human rights, especially children rights. The fulfillment of the right is mentioned in Article 28B Paragraph (2) jo. Article 31 Constitution of the Republic of Indonesia. However, the fullfilment of children rights to education is obstructed by marriage dispentations for female who marry under the age of sixteen. Based on the data taken from Wonosari Religious Court, marriage dispentations are granted a lot more in Ponjong District, Gunungkidul Regency, Daerah Istimewa Yogyakarta Province. The type of research applied in this paper is legal normative research that focusses on the positive form of legal norm and regulation while the data types used are primmary legal materials and secondary legal materials. This research is aimed to analize the fullfilment of the right of female who marry under the age of sixteen to education. The result of the research reveals that the right of daugther to formal and informal education is unfulfilled by the goverment as the duty barrier of the children rights. The female who marry under the age of sixteen can not acces the non-formal education which already provided.
