Abstract

One of the legal requirements of marriage in Indonesian marriage law is both of parties must be do the marriage according to their religion and beliefs. Custom marriage can’t be register because it was not admitted in Indonesia. It will make some effect to the married couple. One of married couple’s duties as a parent is to register their children identity in a certificate of birth. Certificate of marriage which is get from legal married according to the Indonesian marriage law is needed to make certificate of birth. In this legal research, researcher tried to analyze about what factors that makes people do this custom marriage and how about children’s rights of their identities which was happened in Cegolak village, Nanga Tayap sub-district, Ketapang, West Borneo. The method that used in this legal research was empirical legal research. The materials that used in this research were from primary data and secondary data. Those was gathered from interview and literature study. Object of this research are 48 people who was married by marriage custom in Cegolak village. Researcher took 21 person as respondents. Those data was analyzed used qualitative analysis method. The results of this research are children who was born from custom marriage can have their rights of self-identity in a certificate of birth. His/her mother’s name was written in it, but his/her father’s name was not. It will make some effects to father’s duties to the children and children’s rights which are properly received by children.
