Abstract

This minithesis Writing focus on traffic accident caused by because violation of the road marking line.Traffic accident which often happens is a result of human error, as well as violation of the road marking line which led to a traffic accident. The problems on this minithesis is how the process or settlement mechanism about violation of the road marking line that makes traffic accident, The application of punishment against disobedience street mark rules that makes traffic accident which resulted in the death. And the obstacles for the police Departement that fuction as a law enforcer in enforcing the law in handling trafic accident cases.This reseach method used is a normative juridiction legal research. Normative juridiction legal research is legal research focuses on positive legal norms in the form of legislation. Based on the results of the investigation of the completion of the project violation of the road marking line divided into three. The first is the settlement minor accidents, The second is the settlement medium accidents, and the third is the settlement serious accidents. Implementation of sanctions againts motorists resulting accidents based on the article 210 of law No. 22 of 2009 about traffic and road transport. Obstacles faced by the police in enforcing the law in handling violation of the road marking line is unavailability of a tow truck which is used for vehicle carrier that involved in an accident, the witness evidence that is important, evidence in the form of cctv record. The problems of traffic accidents and traffic are mostly related to human behavior or negligence in riding motor vehicle. It is necessary to raise awareness and apply sanctions based on the article 210 of law No. 22 of 2009 about traffic and road transport firmly to cause a deterrent effect.
