Abstract
This research aims to knowing how the legal protection afforded to the child of a rape victim who commits an abortion and what are obstacle factor in giving it. This research is done normatively, that is focusing on secondary data and primary data as supporting. Based on research from interviews and legal analysis conducted by the author, the authors conclude that the legal protection afforded to the child of a rape victim who commits an abortion is a repressive legal protection by using some existing legislation. Based on that conclusion the authors suggest that the Government is expected to provide guarantees and legal protection for rape victims who commit abortion crimes both psychologically and mentally in accordance with procedures and security that have been established based on existing legislation.
