Abstract

Sanctions imposed against Military Soldiers who committed criminal acts of motor vehicle torture. Indonesia has military power which is often called the Indonesian National Army (TNI). In Indonesia there are still many violations committed by military personnel, one of which is the Motor Vehicle Penalahan conducted by TNI officers. the actions undertaken do not describe the functions and duties of a TNI as a state servant, in which the TNI is an institution that should protect the State. The purpose is to know whether the sanctions against military soldiers who committed criminal acts of motor vehicle. Type of research in the writing of this law is a normative legal research, namely research that focuses on positive law in the form of legislation. Methods of data collection is done by way of literature study and interview conducted on Military Court II-11 Yogyakarta. thinking process is done deductively. Sanctions Against Military Soldiers Conducting Criminal Acts of Motor Vehicle Penalty shall be in the form of Prison Criminal Sanction without the dismissal from the Military Service. As also stated in the verdict of Military Court II-11 Yogyakarta, namely sanction in the form of imprisonment for 1 (one) year 6 (six) months.
