Abstract

The potential of fish farming in Indonesia reaches 57.7 tons in a year. Fish cultivation business also provides reliable employment for the welfare of the people of Indonesia. Through Law No. 7 of 2016 on Protection and Empowerment of Fishermen, Fish farmers and Salt Farmers, all fish farming activities involving fish cultivators are required to enter into a production sharing agreement or employment agreement in writing. The law also obliges the Regional Government to provide assistance to the cultivators in making employment agreements or production sharing agreements. Whether the obligations of the Local Government have been implemented and any constraints faced in assisting the drafting of a employment agreement or production sharing agreement will be discussed in this research. This research aims to find out how the implementation of assistance in the making of employment agreements or sharing agreements made by Government of the Special Region of Yogyakarta. This research is an empirical legal research . The type of data that used is primary data, obtained from respondents and supported by secondary data consisting of primary law materials and secondary law materials. Data collection techniques in the form of interviews and data analysis techniques using descriptive method. Implementation of Assistance of Employment Agreement or Production Sharing Agreement in Article 28 paragraph (1) of Law No.7 of 2016 does not work properly. The obstacle are because the local government considers the agreements to be private, so they are not authorized to assiting in the making of the agreements. The author does not agree with the views of respondents.
