Abstract

Violence in the household is a global problem that is still unsettled until today. Law Number 23 of 2004 concerning Elimination of Domestic Violence is the only legal instrument that can be used specifically to settle criminal cases of domestic violence in Indonesia. Violence within the household includes physical, psychological, sexual violence and neglect of households. Physical violence is an act that results in pain, illness, or serious injury. The research was conducted to find out the punishment of the perpetrators of physical violence and what are the obstacles in the punishment of the perpetrators of physical violence in Gunungkidul Regency based on the decision number 94 / Pid.Sus / 2016 / Pn.Wno. This study used normative legal research methods in the form of literature study and conducting interviews. Based on the research conducted, it was concluded that the judge imprisoned the defendant for 6 (six) months after considering juridical and non-juridical factors. In addition, the obstacles include the lack of witnesses in cases of violence within the household which is due to a lack of awareness from the surrounding community to help others, victims who did not dare to reveal the truth due to trauma.
