Abstract

This legal research analyzes criminal responsibility for children as perpetrators of criminal acts of persecution in Bantul district. this legal research uses a normative research methods, which focuses on criminal responsibility for children as perpetrators of criminal acts in the Bantul district area. The criminal responsibility in question is about the criminal responsibility of the perpetrator, which is more than one person or can be called a criminal act of participation. The interviewees in this research are prosecutors at the district prosecutor's office in Bantul district and judges in the Bantul district court. The results show that the application of material criminal law in the Bantul District Court Decision Number: 11 / Pid.Sus-Anak / 2016 / PN.Btl, including the qualification for the inclusion of Children in the Criminal Act is in accordance with legal facts. The panel of judges is deemed fair and equal to the actions of each child and will fulfill the objectives of Criminal Justice which must be preventive, corrective, educative, and have the spirit of Restorative Justice as mandated in the Juvenile Justice and Criminal System Law.
