Abstract

In order to defense interest ,the suspect or defendant is entitled to legal assistance of one or more legal adviser during the time and at all levels of inspection, according to the procedures specified in this law. This provision is very important because someone who is alleged to have commited an offense , not necessarily really have done had accused him. Here the role of advocate is necessary in conducting a defense to the defendant, order a suspect to get liniecy or even separated from all charges. The purpose of this law is to determine the role of lawyers in providing assistance to its (client) at the level of investigation and the constrains faced by lawyers in providing assistance to its clients. Location in Yogyakarta to study the subject of research in Yogyakarta legal aid institute.Data were collected by way of literature study, and documentation. The data in this study were analyzed with descriptive methods, data obtained from primary and secondary data are described in a systematic and logical deductive pattern according to, and the explained , translated, and integrate based on scientific principle. Conclusion the result of the study, the rolr of advocates and the facilitation of the suspects is to enforce the law , either formally or materially despite starting from the subjective view point, which is aligned to the interest of the suspect , uphold and defend the rule of law should not be formal criminal law is wrong or unfairly applied to the a criminal case, as well as an advocates can provide clues about how suspect must be in any reviews process. Constraints negative perception of society towards advocates,the lack of flexibility in the assistan ce and defense, sometimes the client is not honest in providing information positions the actual case, the intimidation of parties who feel harmed in the existence of advocates, as well as the world court has infiltrated by mafia court.
