Abstract

This legal writing is entitled The Verification of General Prosecutor in the Case Processing of Domestic Violence. Domestic violence often results a female as part should gain protection from the state and/or society in order prevented and set free from any violence or threat of violence, torture or submissive treatment to their humanity dignity and degree. In fact the victim is not only the part of wife, it could happen to the part of husband, parent, underage or even non familial member, such as the servant. The conclusion is all of people in the range of house. Whether what had been conducted by the Public Prosecutor to prove the existence of domestic violence? What barriers faced by the Public Prosecutor in verifying the existence of domestic violence? The methodology used was normative research. Thus the conclusion of the research is: Public Prosecutor in collecting the verifying materials should refer to the Article 185 of Criminal Code, it is strengthened by the Article 184 of Criminal Code. Public Prosecutor used the Law Number 23 of 2004 on the Elimination of Domestic Violence to verify in domestic violence, i.e. the Article 55; it is strengthened by the Article 54 of the Law Number 23 of 2004. Meanwhile in practice, the court conducts action as follow: 1) Physical violence is verified by (letter of) visum and witness information (minimally 2 witnesses). 2) Psychical violence is verified by the expert information (in this matter psychiatric/psychologist) and the witness information (minimally 2 witnesses). 3) Sexual violence is verified by (letter of) visum. 4) The domestic passing on is verified by witness information, manual and (letter of) visum.
