Abstract

This thesis is entitled Implementation of the Partnership Agreement and Borrowing Money With Mortgage Guarantee to Land Between the PT. Madu Baru and Sugar Cane Farmers (Case Study PT. Madu Baru Yogyakarta), aims to determine solving problems (default) in the partnership agreement to borrow money by mortgage guarantee that is not registered at the PT. Madu Baru Yogyakarta. The result aims to provide an understanding that support for the legal department of economics and business. The research is empirical legal research in accordance with the existing realities in society and using induction reasoning, the results of empirical legal research is a social fact. Social facts and the source of the data obtained by direct interview to the respondent in the PT. Madu Baru. The author used qualitative descriptive method which systematic understanding, combining and examining collected data, which eventually will lead to a conclusion. The authors conclude for repayment of debt settlement case the debtor defaults because no registration of the mortgage, the mortgage was not born, and all legal aspects relating to the mortgage can not be enforced in this agreement. And the land is seen as a guarantee of general surety, as defined in Article 1131 KUH Perdata (civil law).
