Abstract

Humans need education in their lives. Education can be direct to a formal and informal education. Formal education is a structured and tiered education pathway, while informal education is an unstructured and tiered educational pathway. One example of taking tutoring outside of school is in a tutoring institution. The implementation of tutoring gives birth to a binding relationship between parties, namely between learning guidance institutions and students. The existence of this relationship makes the parties have the rights and obligations that must be fulfilled. Therefore, this study will discuss the implementation of legal protection for students from Tridaya tutoring institutions. The type of legal research used is a type of empirical legal research. This type of research explores positive law in the form of laws, literature, journals, legal facts, and related sources. Tutoring institutions and students have the rights and obligations that must be fulfilled by each party. This must be done so that the position of the tutoring institution and students becomes balanced and no one is harmed. Based on the results of the study, the learning guidance institution is Tridaya and students have fulfilled their rights and obligations in accordance with the agreement and in accordance with the law number 8 of 1999 concering consumer protection. Based on the analysis, it can be concluded that the implementation of legal protection for students from Tridaya tutoring institutions has been in accordance with law number 8 of 1999 concering consumer protection, namely regarding the rights and obligations of students as consumers and turoring institutions as business people, as well as action which is prohibited for business actors.
