Abstract

Transvestites are God's creatures and equal before God. They also should enjoy human rights, including in terms of employment. In fact, many transvestites are still discriminated against in getting jobs. In this study will be known in Indonesian law government the prohibition of discrimination in employment and solutions from the perspective of human rights in order to avoid discrimination against transvestites in getting a job. This study uses a normative method with focus on positive legal in Indonesia. In addition, this study uses resource persons from Psychologist, Scientist from The Center of Population and Development Policy (PSKK) Gajah Mada University in Yogyakarta, and judges of the Court of Yogyakarta. According to the result, all citizens are entitled to employment without discrimination, but the facts are obtained from sources that transvestites discrimination still obtain a given solution is expected to have a special law regulating the transvestites.
