Abstract
Based on act no 31 years 1997 about military article 216 verse (1) army can get legal assistance coming from outside Indonesian National Army legal service provided that there is permission from PAPERA. the purpose of this study is to know the implementation of legal assistance by Advocates from outside the KUMREM for the Indonesian National Army members who proceedings criminal cases in a Military Court, and to know obstacles in the implementation of the provision of legal assistance comes from Advocates outside the KUMREM for the Indonesian National Army members in a Military Court. This study is about a normative legal, this study that focuses on a norm positive law supported with interviews from resource persons. The conclusions from this study is granting legal assistance by Advocates for the Indonesian National Army members in Military Court is equal to the granting legal assistance for the civil society at the general court there was just mechanism and procedures to be followed by soldiers and Advocate them is there are permission from ANKUM and PAPERA, and an Advocate should do registers in Military Court before proceedings the cases Military Court. There are obstacles permit application soldiers need a long time and did not always be allowed, not all the soldier knew that they could use Advocates come from outside KUMREM, the stigma growing among an Advocate that an Advocate cannot provide legal assistance Indonesian National Army members. and for the Indonesian National Army members that want to use an Advocate coming from outside the KUMREM must spend money which is relatively large to pay honorarium an advocate.
