Abstract

The purpose from the research is to determine and analyze about is 2 months imprisonment for the perpetrator of the criminal act of light persecution against domestic animals in the verdict of the District Court Labuha No. 63/Pid.B/2014/PN.LBH is already proper and correct or not. This research is using normative law research methods, which is research that focusing on the norms (law in the books) by using secondary data (material law) as the main data and primary data as the supporting data, that data is processed using deductive data processing. In this study, primary data itself consist of KUHP, KUHAP, UU No. 18 Year of 2009 about Animal Husbandry and Animals Health, UU No. 48 Year of 2009 about The Powers Of The Judiciary, and PP No. 95 Year of 2012 about Veterinary Public Health and Animal Welfare. Whereas, for the secondary data based on the books of law literature, and the opinion from the literature, website, documents, newspaper, and the internet. The result of this research found that, the 2 months imprisonment for the perpetrator of the crime in this case are not proper and wrong. The perpetrator were be able to take the criminal sanctions and was sentenced to imprisonment for 2 months but it is too mild to be the sanctions. In a consideration of animals owner’s material loss, cruel persecution against animal, his attitude that don’t want to apologize to the animals owner and Pela Gandong’s violation, the imprisonment would also be appropiate if the periods is more than 2 months.
