Abstract

This undergraduate thesis is titled Juridical Factor That Caused The Spread of The Imitation of Branded. The research is conducted in the office of the ministry of law and Human Rights, in the sector of intellectual property right in yogyakarta, Directorate of Costoms and Exices Yogyakarta and the Departement of Industry and Trade Yogyakarta. The type of research that is condected is normative legal research. Normative legal research is reseach which focuses on the legislations. The legal materials that used are primary and secondary legal material of primary law which is contains of legislation in accordance with five tasks of normative/ dogmatic: the description of positive law, the systematization of positive law, the analysis of positive law, the interpretation of positive law and to value the positive law. The tought process that used is deduktive. The conclusion of this legal thesis is Undang – undang Nomor 15 Tahun 2001 about a Brand, a crime complaint. The Directorate of customs and excise cannot condact a surveillance without and complaints, which lagerly determines. The suggestions outlined is the active of brand owners and licenses to be able to do the prosecution, trademark registration, transfer of brand, and brand deletion should be more tightened. The goverment must give an out reach to the society about the importance of using original brand.
