Abstract

This thesis is entitled Fulfillment of the Right to Conditional Release for Corruption Prisoners (A Case Study of Hartati Murdaya). This study aims to determine what conditions must be fulfilled by Corruption Prisoners in order to get the Right to Conditional Release. The formulation of the problem in this study is whether the consideration of the Minister of Law and Human Rights is to provide Conditional Release to Hartati Murdaya as a Corruption Prisoner. This legal research is carried out using Normative research methods with a focus on legislation in this case the Criminal Procedure Code (KUHAP), Republic of Indonesia Law Number 12 of 1995 concerning Corrections, and Republic of Indonesia Government Regulation Number 99 Year 2012 concerning the Terms and Procedures for Implementing Correctional Citizens' Rights relating to the Special Conditional Rights for Corruption Prisoners. From this legal research, it can be concluded that the consideration of the Minister of Law and Human Rights in providing Conditional Exemption to Hartati Murdaya, which has undergone 2/3 of her sentence and has paid a criminal fine. In addition, the age and health factors of Hartati Murdaya are also a consideration given parole. Keywords : Parole Rights, Prisioner, Corruption.
