Abstract

Every judicial environment in Indonesia basically has its own authority. Between the one judicial environment and the other judicial environment cannot be combined in the settlement of the case. However, unlike the case of connectivity, the provisions regarding connectivity cases open up the possibility of combining cases caused by criminal acts carried out by civilians and the military together. In accordance with the provisions of the Criminal Procedure Code and Law Number 31 of 1997 concerning military justice, related to cases of connectivity, both civilian actors belonging to the General Judiciary as well as military circles belonging to the Military Courts must be examined and tried jointly (case merged) in court in the General Court unless according to the Decree of the Minister of Defense with the approval of the Supreme Court the case must be examined by a court in the Military Court environment. The purpose of this study was to find out the implementation of the court of connectivity in the Military Justice environment and the obstacles in the court proceedings in the context of connectivity. In discussing the issues raised, the author uses normative legal research methods and is qualitative in nature. The results of the study found obstacles in resolving connectivity cases, including complicated and lengthy procedures because the connectivity team had to be made based on joint decisions from the Supreme Court, Attorney General, Oditur General and Minister of Defense. The author's advice is that there is a need for regulations governing cases of connectivity, especially regarding changes in the mechanism of justice, which is shorter and easier
