Abstract

The existence of customary rights over customary forests in indigenous communities of Tenganan Pegringsingan village. For indigenous communities in Tenganan Pegringsingan village the forest existence strongly supports the sustainability of the custom village of Tenganan Pegringsingan itself. This is because the majority of Tenganan Pegringsingan indigenous community members are still dependent on forest products in Tenganan Pegringsingan traditional village. The utilization of customary forests in Tenganan Pegringsingan traditional village by indigenous peoples is based on customary law in the form of awgi - awig. The problem in this research is how the existence of Communal Right over the forest in indigenous village of Tenganan Pegringsingan. The purpose of this research is to know the existence of communal right to the forest in indigenous village community of Tenganan Pegringsingan. Methods in this study using qualitative analysis methods where the method of data analysis is based on the understanding and data processing systematically obtained from interviews with respondents and resource persons as well as the results of library research. The sample in this study is determined by purposive sampling where the selection of the sample is based on a certain characteristic that is considered to be in accordance with the characteristics of the known population. The existence of communal rights over the forest in indigenous villages of Tenganan Pegringsingan is still ongoing by still enacting awig - awig or customary law contained in Tenganan Pegringsingan traditional village but the constraints faced by Tenganan Pegringsingan traditional villagers is the lack of government role in participating attention and protection of the forests contained in Tenganan Pegringsingan traditional village Keywords: existence, forest, indigenous people, Awig - awig
