Abstract

Ensure the certainty of rights and legal certainty over land, a staple of agrarian legislation has set out the existence of the necessity to carry out a land registry. With the land registry, then asked the parties to the dispute can easily know the status or position of the law of the land facing, spacious layout, and who have and load what is on top of it. In practice though land registry already done, but still the occurrence of double certificate as impinging on the lands in the territory of the province of Central BorneoKatingan Regency. This has been an issue of interest to examined to know the role of the Office of the Province of Central Borneo at Regency Katingan in the prevention of double certificate. This research is a research which examined secondary data is then continued with an examination of the primary file in a field with a cling to facet-juridical standpoint. Data analysis was done with a descriptive-analytic, namely: 1) Factors are that the cause of the onset of double certificate in Katingan Regency Land Office of the province of Central Borneo; and 2) know the role of the Office of the land Central Borneo Province Katingan Regency in the completion certificate. The results of this research show that: 1) Some of the factors that cause the occurrence of Katingan Regency certificate is the owner of land that is not paying attention to his property and tend to let so give people opportunities else to take it over. Furthermore the lack of thoroughness of Land Office Officials in issuing certificates of land should have been crossed out but there are still causing a double certificate. The existing data base is not yet systematically though now there's been an improvement but still a lot of certificates-certificate of terimpentarisir not long so as to allow the emergence of double certificate because the land agency who lived here had received the petition. And then the existence of the local government, neighborhood or village that has no file about the soil-soil that is already and there is already a control or file that is not valid. Local governments sometimes do not perform measurements, it is not checked whether the correct location of the land or the land has not been registered in the name of another person; and 2) the role of the Office of the land Central Borneo Province Katingan Regency in the completion of the double-certificate by always seeking land with dispute resolution solutions based on legal rules that apply with pay attention to the sense of Justice and respect for the rights and obligations of each party. The steps of dispute resolution conducted land office party is with deliberation.
