Abstract

The title of this tesis is The strength of evidences on the criminal case that on the process of geting the evedance have a legal defect. In the research background, writer found that there is a problem on the process of evidence collecting. The impact is a lot cases become more complicated on the trail process. The main problem on this thesis is How qualified the evidenceon the criminal case that on the process of geting the evidance have a legal defect? The objection on this thesis is to find out and analyze the quality of evidence on the criminal case that on the process of geting the evidance have a legal defect. This thesis use normative method to analyze the problem. Normative method is research method that focused on positive rule which is Legislation. Based on the research, writer found that legal defect what is meant is a prosedural legal defact. This kind of legal defact make Not achieving the purpose of the trial that is material truth and justice.
