Abstract

This thesis entitled The Juridical Study on Provison for Outsourced Workers by the Constitutional Court’s Decision Number 27 / PUU – IX / 2011. Violations of law in the implementation of the regulations for outsourced workers underlying this Constitutional Court’s Decision. The emerging legal problem is, how the provision of the outsourced workers by the Constitutional Court’s Number 27 / PUU – IX / 2011? The kind of legal research, which has been used by the writer, is normative research, which analyze the valid law norms. The writer has exmined literature that was a secondary data, and interviewed a source. The conclusion of this research is Constitutional Court gives additional rules which previously unregulated in Act No. 13, 2003. The Constitutional Courts requires the outsourcing agreement in the unspecified time work agreements form. Constitutional Court requires the transfer of protection to the workers rights whose work object does remain if the agreement formed by time work agreement. With this Constitutioal Court’s Decision, the working lives has passed continues to be recognized, so that the outsourced workers still get their rights as a workers appropriately and proportionately.
