Abstract

Maladministration is a behavior or act legal against, including omission or neglect of legal responsibility in the enforcement of public services execute by the state and government executan that cause harm and / or immaterial society and individual. Maladministration in the execution of death penalty convicts is the execution of death penalty convicts who are not in compliance with the procedures or clause of legal applicable that cause harm to death penalty convicts because their constitutional rights are violation. The execution of death penalty convicts can’t be done before the president decides to refuse or accept the petition for the clemency of the death penalty convicts. However, the absence of clear and unequivocal regulation concerning legal consequences for prosecutors and legal remidies for death penaly convicts who are applying for clemency but have been executed prior to a presidential decree on rejection of clemency. This research was done by using normative method and using primary and secondary legal material and data collection was done by using literature study and interviews. The legal consequences which may be imposed on an prosecutors may be an administrative act of omission or neglect of its responsibility and legal remedies which the heirs or legal advisor of the death penalty convicts shall be the submission of a compensation petition for a gross human rights violation resulting from a violation of the constitutional rights of death penalty convicts.
