Abstract

The title of this legal research is Conviction Of Members Of The Indonesian National Army Who Committed Adultery. The formulation of the problem in this study is whether criminal sanctions against members of the Indonesian national army committing adultery? and Are there factors that hinder the imposition of criminal sanctions on members of the Indonesian national army who commit adultery?. The conclusion of this legal is The criminal sanctions imposed on members of the Indonesian national army committing criminal acts of adultery are basic criminal sanctions in the form of 9 months imprisonment and additional criminal penalties, namely dismissal from military service. Whereas members of the Indonesian national army who commit criminal acts of adultery with civilians will be subject to criminal sanctions based on Article 284 of the Criminal Code. The factor that inhibits the imposition of criminal sanctions on members of the Indonesian national army committing criminal acts of adultery is that the defendant denies the question and the incomplete evidence or absence of witnesses except the victim.
