Abstract

Prohibition of playing kites in Pontianak City as regulated by Article 22 paragraph (1) of Regional Regulation of Pontianak City Number 3 of 2004 concerning Public Order is set out by Head of Region Decree. Article 22 paragraph (2) provides the prohibition of playing kites in places where it is allowed to play is banned from using any kind of materials such as rope from metals, metals, wires as regulated in. Prohibition of playing kites organized by the Regional Government to overcome objections to public order by kite players. This study aims to determine the factors causing ineffectiveness of Pontianak City Regional Regulation Number 3 of 2004 concerning Public Order in tackling violations of public order by kite players. This research is using empirical legal research conducted with field studies to obtain primary data which is then supported by secondary data from library research. All data are collected through qualitative methods. The results showed that the Pontianak City Regulation Number 3 of 2004 concerning Public Order was ineffective because of facilities, community factors and location factors.
