Abstract

Research entitled "Liability For Members of the Armed Forces who carry out Insubordination". The author chose the title against the background of the Indonesian National Army (TNI) having the main task of upholding a sovereign state, maintaining the territorial integrity of the Unitary State of the Republic of Indonesia. From a legal standpoint, military members have the same position as civilians, but because there is a burden on military members, the special negotiators and the judiciary themselves. Insubordination is an unusual action or seen from the military rules that occur within the military environment. The purpose of this research is to study the forms responsibility for members of the TNI who carry out the Insubordination and to find out what is caused by the involvement of the Insubordination for the military. The research method used is normative by collecting data through literature studies and interviews. The results of the study are for accountability seen from the perspective of the Military Discipline Law and Criminal Enforcement and for the results of the Insubordination are damaging the military discipline, damage the formation of unity and damage of the leadership.
