Abstract

This thesis is titled Legal Protection for the parties in the construction work contract due to the occurrence of force majeure, discussing the protection of law in construction work contracts when the contract execution stage occurs force majeure. The problem of this research is how legal protection for the parties in construction work contracts due to force majeure. The research used in the writing of this thesis is normative legal research using legislation, concept, and case approaches. Based on the results of the study can be concluded that the clause of majeure/force majeure, insurance, and settlement of disputes in contracts as stipulated in article 47 of Law Number 2 of 2017 on construction services is a clause that contains legal protection if in the performance of a contract occurred force majeure, so that the rights of the parties remain guaranteed by law and do not cause harm to the parties, both the service users and service providers. The implications of this research should be that the parties in the construction contract content should pay attention to the clause of the Force and arrange in detail what circumstances or events contained in the contract classified as Force majeure. The parties must also insure materials, equipment, and responsibilities to third parties that may be harmed due to force majeure. The parties may also about their problems through alternative dispute resolution.
