Abstract

The crisis in world oil price caused the Indonesian Government implements conservation programs and reorientation of fiscal policy, among others, is the conversion of kerosene to LPG gas. To make it succeed, the government releases a small size of LPG cylinders that the price can be afforded by marginal communities, which are LPG cylinders 3-kilo grams. The 3 kilo grams tube size was priced less than Rp. 12.000,00. On the count, the use of LPG is less expensive than kerosene. 1 kilo grams of LPG equal with 3 liters of kerosene. The current price of LPG is Rp. 4.250, 00 / kilo grams and kerosene is Rp. 2.000, 00 / litter, so that it can be reached by the society. The government’s programs are applicable to the entire territory of Indonesia, as well as for the district of Klaten in Central Java. The author would like to know whether the implementation of 3 kilo grams gas price fixing agreement and its contents in Klaten district by the business actors is in conflict with Law No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. To determine this problem, the author conducts a research using direct observation and interviews to the respondent, that are the agents covering 3 kilo grams gas cylinder and as well as the contents, in some district of Klaten Regency. Data and information collected by the author is analyzed in qualitative and quantitative methods based on legislation. The author obtain some indications that businessmen in Klaten district have violated a road pricing agreements with other business actors, and very clearly it is contrary to what has been mandated in Law No. 5 Year 1999 concerning Prohibition of Monopoly and Unfair Business Competition. In the end, the author concludes that these violations carried out in various ways, and how the most common approach is to always sell loss associated with market domination. The author gives suggestions to the Klaten District government to carry out control measures to impose sanctions to the perpetrators of business in Klaten regency immediately. In addition, businessperson should give priority to the interests of society as consumers. It's because their consumers who will enjoy what has been produced by the perpetrators of these efforts either goods or services and do not practice price fixing agreements that are not exempted in Article 50 of Law No. 5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. Based on these things, people should be more careful and meticulous with the price fixing agreement practices by the businessman by noticing the difference in price of similar goods and services together in a similar market.
