Abstract

The mining sector makes an important contribution to the government, but the existence of unlicensed gold mining (PETI) has the potential to cause environmental problems. The formulation of the problem in this study is how law enforcement against unlicensed gold mining (PETI) using mercury becomes an effort to combat Kapuas River pollution in Kapuas Hulu Regency. This research is an empirical legal research, data obtained through literature study and interviews with informants and respondents. The results of his research are that PETI mostly occurs in Kapuas Hulu District due to the small income of the community from farming, trading, fishing and rubber gardening so that people look for other alternatives to increase their income by doing PETI. The existence of PETI will cause environmental problems, therefore the existence of PETI must be dealt with. The conclusion is that law enforcement against PETI that uses mercury as an effort to prevent pollution of the Kapuas River in Kapuas Hulu Regency has been carried out by the police according to direct orders from the National Police Chief, Kapuas PETI Operations, although it is not yet optimal and the law enforcement is not optimal on the Kapuas Hulu Regency due to by obstacles, namely the distance to a distant location and passing through forests or swamps, as well as the resistance of PETI perpetrators. The suggestion is that the Kapuas Hulu Regency Government needs to build adequate road access to the villages where PETI is located in Kapuas Hulu Regency, so that supervision can be carried out more efficiently; The West Kalimantan Province Mining Office needs to collect data, develop and educate PETI actors, so that PETI actors can arrange mining permits either individually or cooperatively; and the Kapuas Hulu Regency Government needs to be more assertive in imposing sanctions on the perpetrators of PETI.
